A common — and very smart — question we hear is: are mortgages in Panama recourse or nonrecourse? The answer is that most mortgages in Panama are recourse loans, but the practical implications often differ from what North American buyers expect.

Knowing how recourse works helps buyers assess risk clearly and structure their purchase intelligently.

What does “recourse” mean in Panama?
A recourse mortgage means that if a borrower defaults and the sale of the property does not fully cover the outstanding loan balance, the bank may have the legal right to pursue additional assets or income to recover the difference.

In Panama, the majority of residential mortgages are structured as recourse loans, especially when financing is provided by local banks.

How this works in real life
While the legal structure is typically recourse, enforcement is not automatic or aggressive. In practice:
  • Banks prioritize resolving defaults through the property itself
